Affiliate Program Terms of Use

As an authorized affiliate (Affiliate) of Accurate Precious Metals Refineries, you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting Accurate Precious Metals Refineries as an Affiliate.

Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to Accurate Precious Metals Refineries by your own website or personal referrals.

By signing up for the Accurate Precious Metals Refineries Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Definitions

• • Affiliate: A person or entity that promotes the Company’s website and earns commissions based on referred purchases.

• • Commission: Earnings paid to the Affiliate for qualifying purchases made by customers referred through the Affiliate’s links.

• • Customer: An individual who makes a purchase through the Company’s website.

• • Referral: A customer who visits the Company’s website through an affiliate link and makes a qualifying purchase.

• • Active Account: A customer account that has completed a qualifying purchase and remains active for at least 31 days without any refunds or chargebacks.

• • Qualifying Purchase: A purchase of any membership or product listed on the Company’s website, excluding any purchases made by the Affiliate themselves or through any fraudulent means.

• • Adult Content: Any material that is sexually explicit, contains nudity, or is otherwise intended for adult audiences, including but not limited to, pornography, erotica, or any content that depicts or describes sexual activity or nudity.

• • Drugs and Alcohol: Any substances that are controlled or regulated under applicable laws, including but not limited to, illegal drugs and alcoholic beverages.

• • Sanctions Lists: Any list of individuals or entities subject to economic sanctions imposed by the United States or any other applicable jurisdiction.

• • OFAC List: The list maintained by the Office of Foreign Assets Control (OFAC) of the U.S. Department of the Treasury, which includes individuals and entities subject to U.S. economic sanctions.

Role of the Affiliate

• • The Affiliate’s role is solely to promote the Company’s website and earn commissions on qualifying purchases.

• • The Affiliate does not handle any customer transactions, does not collect any customer data, and does not have any KYC or AML obligations.

• • Any customer data is handled solely by the Company, in compliance with all applicable laws and regulations.

• • The Affiliate must ensure that all promotional materials clearly indicate that any claims or representations made are their own and not those of the Company, and that customers should refer to the Company’s website for accurate information.

Commissions

• • Commissions will be paid once a month.

• • For an Affiliate to receive a commission, the referred account must remain active for a minimum of 31 days.

• • You cannot refer yourself, and you will not receive a commission on your own accounts.

• • Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

• • Inappropriate advertisements (false claims, misleading hyperboles, etc.).

• • Spamming (mass email, mass newsgroup posting, etc.).

• • Advertising on sites containing or promoting illegal activities.

• • Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.

• • Violation of intellectual property rights. Accurate Precious Metals Refineries reserves the right to require license agreements from those who employ the Company’s trademark(s) in order to protect our intellectual property rights.

• • Offering rebates, coupons, or other forms of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with Accurate Precious Metals Refineries, however, is acceptable.

• • Self-referrals, fraudulent transactions, suspected Affiliate fraud.

• • Making false or misleading claims about the Company’s products, services, prices, or any other aspect, specifically including unauthorized claims about the value, purity, or any other characteristics of the precious metals sold by the Company.

• • Promoting any products or services not listed on the Company’s website.

• • Promoting the Company’s products or services using Adult Content or on websites that feature Adult Content.

• • Promoting or associating the Company’s products or services with Drugs and Alcohol.

• • The Company determines that the Affiliate is on any Sanctions Lists or the OFAC List.

• • Making any claims or representations about the profitability or return on investment of the Company’s products or services that are not explicitly stated on the Company’s website.

• • Engaging in any activity that could damage the Company’s reputation or violate any law or regulation.

In addition to the above, Accurate Precious Metals Refineries reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason. By accepting these terms and conditions, you agree to forfeit any and all unpaid commissions upon account termination. In simple terms, if we choose to terminate your affiliate account or program, all your unpaid commissions will become immediately void, unpayable, and become the sole property of Accurate Precious Metals Refineries.

Prohibited Conduct

• • Making false or misleading claims about the Company’s products, services, prices, or any other aspect.

• • Specifically, making unauthorized claims about the value, purity, or any other characteristics of the precious metals sold by the Company.

• • Promoting any products or services not listed on the Company’s website.

• • Engaging in any activity that could damage the Company’s reputation or violate any law or regulation.

• • Promoting the Company’s products or services using Adult Content or on websites that feature Adult Content.

• • Promoting or associating the Company’s products or services with Drugs and Alcohol.

• • Making any claims or representations about the profitability or return on investment of the Company’s products or services that are not explicitly stated on the Company’s website.

Affiliate Links

• • You may use graphic and text links both on your website and within your email messages.

• • You may also advertise the Accurate Precious Metals Refineries site in online and offline classified ads, magazines, and newspapers.

• • You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.

Coupon and Deal Sites

• • Accurate Precious Metals Refineries occasionally offers coupons to select affiliate and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon.

• • Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:
    
    • • Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
    
    
    • • Affiliates may not bid on Accurate Precious Metals Refineries Coupons, Accurate Precious Metals Refineries Discounts or other phrases implying coupons are available.
    
    
    • • Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
    
    
    • • User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e., “click here to see coupons and open a window to merchant site” is NOT allowed).
    
    
    • • Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

Pay Per Click (PPC) Policy

• • PPC bidding is NOT allowed without prior written permission.

Data Handling

• • The Affiliate must not collect, store, or process any sensitive customer data, including but not limited to personal identification information, financial information, or any data related to precious metals transactions.

• • Any data shared with the Company must be in accordance with the Company’s privacy policy and applicable data protection laws.

Disclosures

• • The Affiliate must clearly disclose their relationship with the Company in all promotional materials, in compliance with Federal Trade Commission (FTC) guidelines.

Relationship of Parties

• • The relationship between the Company and the Affiliate is that of independent contractors.

• • The Affiliate is not an employee, agent, or representative of the Company, and has no authority to bind the Company in any way.

• • The Company is not responsible for any acts or omissions of the Affiliate, except as provided in this Agreement.

Notification

• • All notices or communications under this Agreement must be in writing and delivered via email to the addresses provided.

• • The Company may also post notices on its website.

Liability

• • Accurate Precious Metals Refineries will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

• • We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by Accurate Precious Metals Refineries. We make no claim that the operation of the Program and/or our website(s) will be error-free, and we will not be liable for any interruptions or errors.

• • We have zero control over what codes clients use at checkout and or what link they use. By agreeing to these terms, it’s understood that if you know specifically a customer did a transaction but you didn’t get credit due to, but not limited to, website error, software error, or any mistakes, we are not liable to give you commissions.

Term of the Agreement

• • The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

• • The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

Indemnification

• • The Affiliate shall indemnify and hold harmless Accurate Precious Metals Refineries and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Accurate Precious Metals Refineries to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of the Affiliate, including any violation of applicable laws or regulations.

Compliance with Laws

• • The Affiliate must comply with all applicable laws and regulations, including but not limited to, those related to anti-money laundering, know-your-customer, and economic sanctions.

• • The Affiliate represents and warrants that it is not on any Sanctions Lists or the OFAC List, and will not engage in any transactions or activities that violate any applicable laws or regulations.

• • The Affiliate agrees to immediately notify the Company if it becomes aware of any violation of this section.

Customer Acknowledgment

• • Customers are not to rely on any representations or guarantees made by the Affiliate, and any such representations do not bind the Company.

• • The Company is not responsible for any claims or guarantees made by its affiliate partners.

Governing Law

• • This Agreement is governed by the laws of Oregon, and any disputes will be resolved in the courts of Oregon.

Force Majeure

• • The Company is not liable for any delays or failures in performance due to circumstances beyond its reasonable control, such as acts of God, strikes, pandemics, or other similar events.

Severability

• • If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

• • The Company may replace the invalid or unenforceable provision with a valid and enforceable provision that achieves the same purpose.

Electronic Signatures Effective

• • The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Accurate Precious Metals Refineries affiliate program.

• • You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Accurate Precious Metals Refineries application process.

• This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
